A federal judge has ordered the immediate discharge of Kilmar Abrego Garcia from immigration custody, finding his ongoing detainment is without lawful basis.

"Since Abrego Garcia's release after wrongful imprisonment in El Salvador, he has been re-detained, again without lawful authority," the judge stated in her ruling.

The situation stems from a mistaken deportation to El Salvador earlier this year, which the government later acknowledged was an error. After his return to the United States to face human smuggling allegations, he was held in immigration detention.

In her order, the judge pointed out that the authorities lacks a valid deportation order, which effectively blocks them from removing Mr. Abrego Garcia "for now."
